This Privacy Policy explains how BabySOS, Inc. ("BabySOS," "we," "us") collects, uses, shares, and protects your personal information when you use the BabySOS app and website (the "Platform"). By using the Platform, you agree to this Policy. Capitalized terms not defined here have the meaning given in our Terms of Service.

1. Overview

BabySOS connects Parents with independent Caregivers for planned and on-demand childcare. To do that safely, we collect information you provide, information generated as you use the Platform, and information from trusted third parties such as our payment processor and background-check provider. We do not sell your personal information.

2. Information we collect

Information you provide

  • Account & profile: name, email, phone number, password, role (Parent/Caregiver), profile photo, bio, and preferences.
  • Parent details: the number and ages of your children, care preferences, and care notes you choose to share.
  • Caregiver details: experience, qualifications, certifications, availability, rates, service area, and photos.
  • Identity & verification data: information needed to verify your identity and, for Caregivers, to run a background check (see Section 8).
  • Payment information: processed by our payment provider; we receive limited details (e.g., card brand, last four digits, transaction status) but not your full card number.
  • Communications: in-app messages, SOS requests, reviews, ratings, and messages to support.

Information collected automatically

  • Device & usage data: device model, operating system, app version, identifiers, log data, and how you interact with the Platform.
  • Location data: precise or approximate location, with your permission (see Section 5).
  • Cookies & similar technologies on our website for functionality and analytics.

3. How we collect information

We collect information directly from you, automatically as you use the Platform, and from third parties including our payment processor (Stripe), our background-check provider (Checkr), identity-verification services, and analytics/notification providers.

4. How we use your information

  • Create and manage your account and profile;
  • Match Parents and Caregivers and facilitate Bookings and SOS requests;
  • Process payments, payouts, and background-check fees;
  • Verify identity and facilitate background checks to support trust and safety;
  • Enable messaging, reviews, check-in/check-out, and timesheets;
  • Send service communications and push notifications (e.g., booking and SOS alerts);
  • Provide customer support and resolve disputes;
  • Detect, prevent, and respond to fraud, abuse, and security incidents;
  • Improve and develop the Platform and comply with legal obligations.

5. Location data

With your permission, we use your device location to show nearby Caregivers, calculate distances, route SOS requests to Caregivers in your area, and improve matching. You can grant or revoke location permission at any time in your device settings. Disabling location may limit features such as distance-based search and SOS routing.

6. Photos & media

With your permission, BabySOS accesses your device camera and photo library so you can add a profile photo, build a caregiver photo gallery, or upload verification documents. We only access the specific images you choose to upload. Profile photos you upload may be visible to other users as part of your profile.

7. How we share your information

We share personal information only as described below. We do not sell your personal information.

  • With other users: profile information, photos, ratings, and messages are shared with the Parents and Caregivers you interact with, as needed to coordinate care.
  • With service providers: payment processing, background checks, identity verification, cloud hosting, analytics, and push notifications (see Section 8).
  • For legal reasons: to comply with law, respond to lawful requests, enforce our Terms, or protect the rights, safety, and property of users, the public, or BabySOS.
  • Business transfers: in connection with a merger, acquisition, financing, or sale of assets, subject to this Policy.
  • With your consent: in other cases where you direct us to share.

These providers process your information on our behalf under their own privacy terms. Background checks are performed by a consumer reporting agency in accordance with the Fair Credit Reporting Act and applicable law.

9. Data retention

We keep your information for as long as your account is active and as needed to provide the Platform, then retain and use it as necessary to comply with legal obligations, resolve disputes, prevent fraud, and enforce our agreements. When no longer needed, we delete or de-identify it. Certain transaction and verification records may be retained longer where required by law.

10. How we protect your information

We use administrative, technical, and physical safeguards designed to protect your information, including encryption in transit, access controls, and secure infrastructure. Payment card data is handled by our PCI-compliant payment processor. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. Protect your account by using a strong password and keeping your credentials confidential.

11. Your choices & rights

  • Access & update: view and edit your profile and account information in the app.
  • Permissions: control location, camera, photo, and notification access in your device settings.
  • Marketing: opt out of promotional messages; you will still receive essential service messages.
  • Delete your account: request deletion at support@babysos.app, subject to legal retention requirements.

12. U.S. state privacy rights

Depending on where you live (for example, California, Virginia, Colorado, Connecticut, and other states with privacy laws), you may have the right to: know and access the personal information we hold about you; request correction or deletion; obtain a portable copy; and opt out of certain sharing or targeted advertising. We do not sell your personal information and do not share it for cross-context behavioral advertising. We will not discriminate against you for exercising these rights. To make a request, email support@babysos.app; we may need to verify your identity before responding. You may use an authorized agent where permitted by law.

13. Children's privacy

The Platform is intended for adults (18+) and is not directed to children. We do not knowingly collect personal information directly from children. Parents may provide limited information about their children (such as ages and care notes) to arrange care; this information is used only to facilitate care and is treated as the Parent's personal information under this Policy. If you believe a child has provided us personal information directly, contact us and we will delete it.

14. International users

BabySOS is operated in the United States and intended for U.S. users. If you access the Platform from outside the United States, you understand your information will be processed in the United States, where data-protection laws may differ from those in your location.

15. Changes to this Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you through the Platform or by other reasonable means and update the "Last updated" date above. Your continued use after changes take effect constitutes acceptance of the updated Policy.
